1. Scope and Acceptance
1.1 These Website Terms of Use govern your use of trustregimen.com and any page we operate on it (the “Site”). The Site is operated by Regimen, Inc., a Delaware corporation.
1.2 Buying an Organizer is governed by the Preorder Terms of Sale. Using the Application is governed by the App Terms of Use. How we handle information is described in the Privacy Policy. Where these Terms conflict with any of those, that document controls as to its subject.
1.3 By using the Site you agree to these Terms. If you do not agree, do not use the Site.
1.4 We may change these Terms, and changes take effect when posted. Changes do not affect an order you have already placed.
2. Who May Use the Site
2.1 You must be at least eighteen (18) years old to buy from the Site or submit information through it.
2.2 The Site is not directed at children. If you believe a child has given us information, email [email protected] and we will delete it.
2.3 The Site is intended for people in the United States.
3. Permitted and Prohibited Use
3.1 You may use the Site to learn about our products, contact us and place preorders or orders when available. No other use is permitted.
3.2 You may not: use the Site unlawfully; copy, republish, scrape, mirror or redistribute the Site or its contents beyond ordinary browsing; access the Site by automated means that burden our infrastructure; attempt unauthorized access to the Site or any connected system; probe or test the Site’s security or circumvent any security measure; introduce malware; misrepresent your identity or affiliation; use the Site or its contents to build a competing product or train a machine learning model; or remove or alter any proprietary notice.
3.3 We may suspend or terminate your access for breach of this Section.
4. Our Content
4.1 The Site and its contents, including text, design, graphics, images and interface, are owned by us or our licensors and protected by copyright, trademark and other laws.
4.2 REGIMEN and our logo are our trademarks.
4.3 We grant you a limited, revocable, non-exclusive, non-transferable license to view the Site for your own personal, non-commercial use. Nothing else is granted.
5. What You Send Us
5.1 If you send us feedback, suggestions or ideas, you grant us a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use them for any business purpose, without compensation or attribution.
5.2 You confirm that what you send is yours to give and does not infringe anyone’s rights.
5.3 Do not include medication details or other sensitive health information in general website feedback. Personal information you provide is handled under the Privacy Policy. Section 5.1 does not grant us a license to use your health information for unrelated business purposes.
6. Health Disclaimer
6.1 NEITHER THE SITE, THE ORGANIZER NOR THE APPLICATION IS A MEDICAL PRODUCT, AND NONE GIVES MEDICAL ADVICE.
6.2 Nothing on the Site diagnoses, treats, cures, mitigates or prevents any disease or condition, and nothing on the Site replaces a qualified healthcare professional.
6.3 The Organizer records when a compartment is opened. It does not confirm that medication was taken. Do not rely on it for anything time-critical. IN AN EMERGENCY, CALL 911.
7. Product Information
7.1 We try to describe our products accurately, but the Site may contain errors, and product information, features, specifications and pricing may change.
7.2 Images and renderings are illustrative. A product you receive may differ in appearance from an image on the Site.
7.3 Showing a product on the Site is not an offer to sell. Orders are placed and accepted under the applicable terms presented when ordering, including the Preorder Terms of Sale for preorders.
7.4 Features described as planned or in development are not commitments. Do not buy in reliance on a feature that has not shipped.
8. Communications
8.1 We may email you updates, and you may unsubscribe at any time. If you place an order we will still send messages about that order and your subscription.
8.2 We do not send marketing text messages.
9. Disclaimers and Liability
9.1 TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ITS CONTENTS ARE PROVIDED AS IS AND AS AVAILABLE, WITHOUT WARRANTY OF ANY KIND, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OR ACCURACY, OR THAT THE SITE WILL BE SECURE, UNINTERRUPTED OR ERROR-FREE.
9.2 TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE, AND OUR TOTAL LIABILITY RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100.00).
9.3 These limits do not apply to death or personal injury caused by our negligence, to fraud, to our gross negligence or willful misconduct, or to any liability that cannot be limited under applicable law.
9.4 This Section covers the Site. It does not affect the Limited Warranty on the Organizer or your rights under the Preorder Terms of Sale.
10. General
10.1 We do not promise the Site will be available, uninterrupted or error-free, and we may change, suspend or discontinue any part of it.
10.2 If you use the Site in violation of these Terms or applicable law and a third party brings a claim against us because of it, you will defend and indemnify us against that claim, including reasonable legal fees. This does not apply to ordinary use of the Site, to anything arising from a product you bought from us, or to any claim caused by our own conduct.
10.3 These Terms are governed by the laws of the State of Michigan, without regard to its conflict of laws rules, except that this does not deprive you of the protection of any mandatory consumer protection law of the state where you live.
10.4 Before starting any proceeding, email us at [email protected] and give us thirty (30) days. Any dispute not resolved that way will be brought in the state or federal courts located in Washtenaw County, Michigan. Either party may bring a qualifying claim in small claims court.
10.5 If a provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it.
